Terms of Service

1. Accepting these terms

These Terms of Service (“Terms”) are an agreement between you and Gilazi (“Gilazi,” “we,” “us”) and govern your use of gilazi91.site, our apps, AI characters, games and related services (the “Service”). By creating an account or using the Service, you agree to these Terms and acknowledge our Privacy Policy. If you don't agree, please don't use the Service.

2. Eligibility

• You must be at least 18 years old, or the age of majority in your jurisdiction if higher.
• You must be legally able to enter into a binding contract and not be barred from using the Service under applicable law.
• You are responsible for making sure your use of the Service, including social casino-style games, is lawful where you live. The Service is not available where prohibited.

3. Your account

You need an account to use most features. Provide accurate information, keep your login details confidential and let us know promptly if you suspect unauthorized access. You are responsible for activity under your account. Accounts are personal — you may not sell, transfer or share them. We may reclaim usernames that impersonate others, infringe rights or have been inactive for an extended period.

4. AI characters & AI output

• Fictional characters. AI characters, including those created by other users, are fictional. They are not real people, do not have feelings or consciousness, and do not represent the views of Gilazi.
• Output may be inaccurate. AI-generated responses can be wrong, incomplete, surprising or inappropriate. Do not rely on them for medical, legal, financial, mental-health or other professional advice, or for decisions with significant consequences.
• Your responsibility. You are responsible for how you prompt characters and how you use their output. Don't use the Service to generate content that violates these Terms or the law.
• Similar outputs. Because of how AI works, other users may receive output similar to yours. Output generated for others is not your content.
• Safety systems. We use filters and moderation that may block, modify or remove prompts and responses. We may change character behavior to improve safety or quality.
• Need help? If you are in crisis or thinking about harming yourself, contact local emergency services or a crisis line — not an AI character.

5. Your content

“Your Content” means characters, descriptions, images, messages and anything else you create, upload or send through the Service, including AI output generated in response to your inputs, to the extent permitted by law.

• Ownership. As between you and us, you keep ownership of Your Content.
• License to us. You grant Gilazi a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, process, adapt, display and distribute Your Content as needed to operate, secure, promote and improve the Service. For private content, this license is limited to operating and securing the Service and the uses described in our Privacy Policy. The license ends when you delete the content, except for copies kept in backups or as required by law, and content you've shared that others have already copied or interacted with.
• Public characters. If you publish a character, you also grant other users a license to interact with it within the Service.
• Your promises. You confirm you have the rights needed to share Your Content, and that it doesn't infringe anyone's intellectual property, privacy or publicity rights.
• Removal. We may remove or restrict any content that we believe violates these Terms or could harm users or the Service.

6. Community rules

Gilazi should be fun for everyone. You agree not to:

• Create or request content that sexualizes minors, depicts or promotes sexual violence, or involves non-consensual intimate imagery.
• Harass, bully, threaten, dox or promote hatred against any person or group.
• Create characters that impersonate real people in a misleading or harmful way, including public figures, without clear parody labeling.
• Promote self-harm, violence, terrorism, illegal drugs or other illegal activity.
• Spam, scam, phish or advertise without permission.
• Cheat, exploit bugs, use bots or automation, or manipulate games, leaderboards or coin balances.
• Buy, sell, trade or transfer accounts, coins or items outside the Service, or offer real-world value for them.
• Attempt to extract our models, prompts or source code, bypass safety systems (“jailbreaking”), or reverse engineer the Service except where the law allows.
• Interfere with the Service's operation, security or other users' enjoyment.
• Infringe intellectual property or privacy rights, or upload malware.

7. Virtual coins & items

• The Service includes virtual currency (“Coins”) and virtual items, which you may earn through play, receive as bonuses, or obtain with optional purchases.
• Coins and items are a limited, personal, non-transferable, revocable license to use certain features of the Service. They are not property, have no monetary value, and cannot be redeemed, cashed out, sold, exchanged or transferred for money, goods or anything of value, inside or outside the Service.
• Outcomes in slots and other chance-based games are determined by a random number generator and are for entertainment only. Success in these games does not imply future success at real-money gambling.
• We may change, rebalance or discontinue Coins, items, games and their prices or odds at any time, to the extent permitted by law.
• Unused Coins and items may be forfeited if your account is closed or terminated, or after extended inactivity, except where prohibited by law.

8. Purchases & refunds

Optional purchases are processed by the app store or payment provider you use, and are subject to their terms. Prices are shown before purchase and may include applicable taxes. All purchases are final and non-refundable, except as required by law or by the applicable app store's refund policy. If you live in the EU or UK, you agree that delivery of digital content begins immediately upon purchase and you lose your right of withdrawal once delivery starts. If you think a purchase was made in error, contact the app store or us at support@gilazi91.site.

9. Our intellectual property

The Service — including software, games, featured characters, artwork, logos and the Gilazi name — is owned by us or our licensors and protected by intellectual property laws. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial entertainment. If you send us feedback, we may use it without obligation to you.

10. Third-party services

The Service may integrate or link to third-party services, such as sign-in providers, app stores and payment processors. We are not responsible for third-party services, and your use of them is governed by their own terms and privacy policies.

11. Suspension & termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access, remove content, or reset balances if you violate these Terms, if required by law, or to protect users or the Service. Where reasonable, we will tell you why. Sections that by their nature should survive termination — including content licenses for shared content, coin terms, disclaimers, limitation of liability, indemnification and dispute terms — will survive.

12. Disclaimers

The Service, including all AI output, is provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement and accuracy. We do not warrant that the Service will be uninterrupted, secure or error-free, or that AI output will be accurate, appropriate or reliable.

Some jurisdictions don't allow certain disclaimers, so some of the above may not apply to you. Nothing in these Terms limits rights you have under consumer protection laws that cannot be waived.

13. Limitation of liability

To the maximum extent permitted by law, Gilazi and its affiliates, officers, employees and partners will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, data, goodwill or virtual items, arising out of or related to the Service. Our total liability for any claim related to the Service is limited to the greater of (a) the amount you paid us in the 12 months before the claim or (b) USD $100.

These limits don't apply to liability that cannot be limited by law, such as for death or personal injury caused by negligence, or fraud.

14. Indemnification

To the extent permitted by law, you agree to defend, indemnify and hold harmless Gilazi and its affiliates from claims, losses and expenses (including reasonable legal fees) arising from Your Content, your use of the Service or your violation of these Terms or the rights of others.

15. Governing law & disputes

These Terms are governed by the laws of the jurisdiction in which Gilazi is established, without regard to conflict-of-law rules, except where the mandatory consumer protection laws of your country of residence apply. Before filing a claim, please contact us at support@gilazi91.site so we can try to resolve the issue informally within 30 days. If we can't, disputes will be resolved in the competent courts of that jurisdiction, unless you are a consumer entitled by law to bring proceedings in your local courts.

16. Changes

We may update these Terms to reflect changes to the Service or the law. For material changes, we will notify you in the Service or by email before they take effect. If you continue using the Service after the changes take effect, you accept the updated Terms. If you don't agree, stop using the Service and delete your account.

17. General

• Entire agreement. These Terms and our Privacy Policy are the entire agreement between you and us about the Service.
• Severability. If any provision is found unenforceable, the rest remains in effect.
• No waiver. Our failure to enforce a provision is not a waiver of our right to do so later.
• Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition or sale of assets.
• Language. If we provide translations, the English version controls to the extent permitted by law.
